Terms and Conditions
These Terms and Conditions of Use apply to the website published at the address www.lespringo.it and to any associated sites. Le Springo reserves the right to change, modify, add or remove parts of these Terms of Use at its sole discretion and at any time. The user is required to periodically consult the Terms of Use to check for any changes. BY USING THE SITE, YOU ACCEPT THESE TERMS OF USE; IF YOU DO NOT ACCEPT, THE USER MUST REFRAIN FROM USING THE SITE.
GENERAL TERMS AND CONDITIONS OF USE
1) General Conditions of Sale
By online or e-mail sales contract we mean the distance contract concluded between the seller and its customers, directly through the Internet, through the procedures established by the seller, for the exchange of the goods marketed by the seller with the requested price. By Customer we mean the person who purchases goods and services, according to the definition given by Italian law.
These General Conditions of Sale (hereinafter referred to as "General Conditions") exclusively regulate the contractual relationships between the customers of the site (hereinafter referred to as "Customer/s") and the seller, the online shop, hereinafter referred to as LeSpringo (with reference to the domain www.lespringo.it/com,) exclusively owned by the individual company Le Springo di Giacomo Gabriele Spingola VAT number. 03615310921 with registered office in Via Famagosta 42 post code 09134, Cagliari (CA) Tel:+39 3913258462. Registered in the Cagliari Company Register with the Economic and Administrative Repertoire number CA-285835.
These General Conditions are the only ones that can be applied and replace all other conditions, except for preliminary, express and written exceptions. The seller may be obliged to modify some of these provisions; Customers are therefore advised to read the General Conditions each time they visit the Le Springo website (hereinafter referred to as the "Site"). These changes are enforceable starting from the online entry and are not applicable to contracts stipulated prior to it. Every purchase on the Site is subject to the General Conditions of Sale applicable on the date of the order. The seller trusts that, once the order has been validated, the Customers have read and accepted the General Conditions of Sale without reservation and have printed or saved a copy. Customers undertake to respect the General Conditions and the Conditions of Use detailed therein.
These general conditions apply exclusively to the purchase of a product and/or service.
1.1) Conditions of sale

The essential characteristics of the goods/services are those indicated. The Consumer enjoys the right of withdrawal provided for by Legislative Decree 6 September 2005 n. 206, under the conditions set out in clause 3.
The products contained in the electronic catalogs are offered at the conditions and prices indicated alongside; any relevant modification will be brought to the attention of the Consumer by similar means.
Legislative decree 6 September 2005 n. applies to contracts concluded with consumer customers. 206.
The public prices are all inclusive of VAT and do not include any taxes, duties and customs duties applicable in the country of destination of the products and/or services if this is different from Italy. These costs, which differ from country to country, are borne by the Customer, who has the sole responsibility of verifying the amount with the competent customs authorities.
All the products in our e-shop are actually available at our headquarters, if there is a shortage of stock it will be promptly reported and the reference will be made unavailable. The site is updated regularly.
The shipment will always be accounted for with a regular accompanying invoice, and unless otherwise indicated by the customer, it will be made available online on their personal orders page (area reserved for customers).
The cost of each shipment must be added to the price of the individual product and/or service, the amount of which may vary based on the delivery and payment method, as well as in relation to the country/region of destination. The total amount due for the selected products and/or services will be clearly indicated and communicated to the Customer before the conclusion of the Sales Contract.
The prices shown on the site are subject to possible variations and/or modifications by lespringo.com without any obligation to notify the Customer. Said increases may depend - among others - on increases decided by LeSpringo's suppliers. The prices in force at the time of receipt of the Order will apply to Sales Contracts concluded before the publication of the aforementioned changes, but still in progress.
Published product prices may vary for different years and formats.
In the event of displaying an incorrect and/or manifestly negligible price, for any reason (computer bug, manual error, technical error, ...), the order will be cancelled, even in the event of initial validation.
The purchasing procedure for a specific product and/or service involves the following phases:
The Customer chooses to purchase the product from the LeSpringo online store.
The Customer confirms and indicates the updated billing information.
The Customer provides the requested information, chooses the payment method and, being aware of all the relevant conditions of sale, expresses his consent by 'clicking' on the appropriate space.
The seller confirms receipt of the order to the Customer and undertakes to comply with the fulfillment of the order.
Once the order has been confirmed, the seller undertakes to validate the customer and insert him into his database.
2) Defective goods/damaged shipment
2.1) Defective goods:
the same can be returned to Le Springo within 10 working days of delivery.
Shipping and packaging costs for returning the shipment are the responsibility of the customer.
Defective goods will be returned or refunded, if they are out of stock, by Le Springo.
2.2) Damaged shipment:
If you receive packages from Le Springo that are visibly damaged by the courier (packages broken or visibly stained by product leakage from any broken bottles) you can do the following:
If there are multiple packages, return the damaged package to the sender by signing the courier's note "With Reserve". We will then take care of returning the damaged package and sending it back to you.
However, if it is a single package shipment, reject the shipment to the sender and, as before, we will take care of the return and restoration of the shipment.
If the damaged item runs out, you will be contacted for a possible replacement; if you do not find any replacement product in our catalogue, Le Springo will proceed to refund the sums paid. Any shipping costs for returning the damaged package to the sender and returning the new one are borne by Le Springo.
3) Right of withdrawal
3.1) Information on the right of withdrawal
Sales of products via the Internet are governed by Legislative Decree 6 September 2005 n. 206 which regulates the matter of distance contracts, i.e. carried out outside commercial premises.
This legislation establishes the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and obtain reimbursement of the expense incurred.
3.2) Conditions of the right of withdrawal
In order to grant the right of withdrawal of a product it will be necessary to respect the following conditions:
the purchased good must be intact,
the right of withdrawal is reserved only for natural persons, therefore excluding purchases made by resellers or by subjects who in any capacity purchase for resale to third parties,
shipping costs will be borne by the customer
upon arrival at the warehouse, the goods will be examined to assess any damage or tampering (the substantial integrity of the returned goods is an essential condition for exercising the right of withdrawal) therefore we recommend maximum attention when preparing the package, possibly trying to use the original packaging,
to exercise this right it is necessary to send a communication to this effect within 10 working days from the date of receipt of the ordered goods and send the goods to us within a further 15 days.
3.3) Withdrawal procedure
The withdrawal procedure is structured as follows:
Send an email to info@lespringo.com containing the declaration that you wish to apply the right of withdrawal, providing evidence of all the requested data:
order number and order date
invoice number
which products must be subject to withdrawal
your bank details (IBAN code)
Wait for a communication from Le Springo Customer Service authorizing the return.
Having received this communication, send the goods subject to withdrawal within a further 15 days to Le Springo di Gabriele Spingola

3.4) Refund timing
In accordance with the art. 67, paragraph 4, legislative decree 6 September 2005 n. 206, Le Springo undertakes to reimburse the customer within 15 working days of receipt of the goods, crediting the customer with the amount corresponding to the value of the goods resulting from the invoice. Shipping costs are not included in the aforementioned amount.
4) Product/service guarantees
Based on the legal guarantee of conformity, the seller undertakes to deliver an order that complies with the concluded sales contract and to respond for any defects of conformity found.
To be considered compliant with the contract, the products must:
- correspond to the description on the Site at the time the order was placed;
- present the usual quality and characteristics of a product of the same type, which the consumer can reasonably expect, taking into account the nature of the product and the characteristics described on the Site.
In the event of an obvious lack of conformity, it will be necessary to restore the conformity of the defective product.
5) Protection of personal data
The information communicated to us is essential for the processing and forwarding of orders, as well as for the drafting of invoices and warranty contracts; their absence will result in the cancellation of the order.
By registering on the Site, the Customer undertakes to provide us with truthful and authentic information. The communication of false information is contrary to these general conditions as well as the other conditions on the Site.
6) Principle of self-responsibility
In the relationships between the seller and the Customers, the principle of self-responsibility is recognized whereby whoever has custody of the computer from which the order is placed bears the responsibilities that depend on its use.
The Customer is required to enter true data. You may not pretend to be or impersonate any other person, nor may you impersonate any other individual or entity, including fictional personalities. The user shall refrain from using the Site or the Contents for activities that are illegal or prohibited by these Terms of Use, as well as encouraging the execution of any illegal activity.
You may not use techniques such as "deep linking", "page scraping", "robots", "spiders" or other automatic devices, programs, algorithms or methods, or similar or equivalent manual processes, to access, acquire, copy or monitor any portion of the Site or the Content, and you must not attempt to gain unauthorized access to any portion or feature of the Site through hacking, password interception or any other unlawful means.
7) Property rights
All text, graphics, photographs, logos, illustrations and computer code or other materials contained on the Site, including, but not limited to, the design, structure, selection, coordination, expression, appearance and arrangement are protected by corporate image, copyright, patent and trademark laws, as well as various other intellectual property rights and unfair competition laws.
Except as expressly indicated, you may not copy, reproduce, republish, upload, publish, publicly display, encode, translate, transmit or distribute in any way any part of the Site and its contents on any computer, server, website or other medium intended for publication, distribution or any commercial purpose without the prior written consent of Le Springo. The user may use the information on Le Springo products and services intentionally made available for download from the Site, provided that they are used without modifying them or adding their own declarations and that they are used for exclusively informational purposes.
Le Springo may modify, suspend, interrupt the functionality or access to the Site or parts of it, for any reason; modify or change the Site, in whole or in part, and any policy or condition relating to it and suspend the functionality of the Site or parts of it to allow ordinary or extraordinary maintenance operations to be carried out, errors to be corrected or other changes to be made.
8) Limitations of liability
Le Springo is not responsible in the same way for the contents of third party sites present through reporting links within the Site itself.
Le Springo does not guarantee that the site or its contents, services or functionality will be error-free or continuously available, that any defects will be corrected or that the use of the site by the user will provide specific results. The site and its contents are provided "as is" and based on availability. All information provided on the site is subject to change without notice. Le Springo cannot guarantee that documents or other data downloaded from the site will be free of viruses, contamination or destructive characteristics. Le Springo declines any responsibility for acts, omissions and conduct of third parties in connection with or relating to the use of the site and/or services by the user. The user assumes full responsibility for the use of the site and linked sites. If the user is not satisfied with the site or its contents, the sole remedy against Le Springo will be to cease using them. The aforementioned limitation is an integral part of the contract between the parties. The foregoing limitation applies to damages, liability and injury caused by any malfunction, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft, destruction, or unauthorized access, alteration or use, whether for breach of contract, tort, negligence or otherwise.
Le Springo apologizes for any spelling, typing or translation errors in the texts and is relieved of any liability for moral or material damages resulting from these.
